These Terms of Service govern your use of the website oladevelopment.com and any brokerage and advisory services provided by Ola Development ("we", "us", "our") based at C/. Buitre 45, Cerros del Águila, 29649 Mijas, Málaga, Spain.
By using this website or engaging us, you agree to these terms. If you do not agree, please do not use the site or our services.
2. The service we provide
Ola Development is an independent real estate intermediary specialising in new-build developments on the Costa del Sol. Our service includes:
- Curating and presenting a selection of new-build developments
- Arranging viewings, transport, and meetings with developers
- Providing market context, insights, and editorial commentary
- Introducing you to independent legal and financial advisers when requested
We are not the developer, builder, or seller of any property featured on the site, and we do not own the properties we present.
3. Property information is not an offer
All property descriptions, prices, floor plans, completion dates, renderings, and other information shown on the website are provided for guidance only and do not constitute a contractual offer.
Property details may change as developments evolve. Availability, prices, specifications, and completion dates are confirmed only by the developer at the point of signing a reservation or private purchase contract. We make reasonable efforts to keep listings accurate but accept no liability for errors, omissions, or changes made by developers.
4. Enquiries and viewings
When you contact us through the website or by phone or email:
- You confirm the information you provide is accurate
- You agree we may forward your enquiry to the relevant developer where this is required to arrange a viewing or send a brochure
- Viewings are organised in good faith, free of charge to you, and create no obligation to purchase
- We reserve the right to decline an enquiry where we believe it does not match the property profile or where we have reasonable concerns under anti-money-laundering rules
5. Fees and commissions
Our service to buyers is free. When a buyer we have introduced completes a purchase, we receive a commission from the developer (typically a percentage of the sale price). This does not increase the price you pay — the price you see on the developer's price list is the price you pay.
If you instruct us to provide additional bespoke services beyond the standard brokerage scope (e.g. project management, dedicated relocation assistance), those services may be subject to a separate written agreement and fee.
6. Developers and third parties
When you decide to reserve or buy a property:
- The contract is between you and the developer (not us)
- All payments are made directly to the developer (or to its designated escrow account) — never to us
- Reservation, private purchase contracts, and the final escritura are signed between you and the developer
- Bank guarantees on stage payments (Ley 38/1999) are issued by the developer's bank, not by us
We will support you throughout this process, but the legal relationship is with the developer.
7. No legal, financial, or tax advice
Nothing on this website or in our communications constitutes legal, financial, mortgage, tax, or investment advice. Spanish property purchases involve significant legal and tax considerations. You should always engage:
- An independent Spanish abogado (lawyer) for due diligence and contract review
- A Spanish tax adviser if you are unsure about tax implications
- A mortgage broker or your own bank if you require financing
We are happy to introduce you to professionals we know, but you engage them directly and remain responsible for the choice.
8. Intellectual property
The website design, text, graphics, code, and editorial content are owned by Ola Development or licensed to us. You may view, download, and print pages for your personal use in evaluating property purchases. Commercial reuse, republication, or scraping requires our prior written consent.
Property photographs, renderings, and brochures shown on the website remain the property of the respective developers and are used with their permission.
9. Limitation of liability
To the maximum extent permitted by Spanish and EU law:
- The website is provided "as is" and we make no warranties about uninterrupted availability or absence of errors
- We are not liable for any decision you make based solely on information shown on the website without independent verification
- We are not liable for the acts, omissions, defaults, delays, or insolvency of any developer, lawyer, bank, notary, or other third party
- Our total liability for any claim arising from the service is limited to the amount of commission we have received in connection with the relevant transaction (or €1,000 where no commission has been received)
Nothing in these terms limits liability that cannot be limited under applicable law (e.g. for fraud or gross negligence).
10. Governing law and jurisdiction
These terms are governed by Spanish law. Any dispute arising out of or relating to these terms or our services will be subject to the exclusive jurisdiction of the courts of Málaga, Spain. As a consumer, you may also rely on any non-waivable consumer protections available in your country of residence.
